We are committed to protecting your privacy and rights and, for that reason, we have adopted this privacy policy to observe in or with regard to our data collection and disclosure practices for our website and the products and services we provide through our website and underlying technology (collectively, the “Services”). This Privacy Policy applies to information collected via online use of all of the products, services and websites offered by Clussio or its subsidiaries or affiliated companies, as well as to communications with Clussio via email. The term “interviewing companies” as used herein shall include any third-party designees or others operating on their behalf.


1. Consent

The following Privacy Policy terms govern your use of this Web Site (the “Clussio site”) and your relationship with Clussio (“we/us”). By using the Clussio site you agree to be bound by this Privacy Policy. This Privacy Policy may change without further notice to you and we recommend you check the Privacy Policy when you use the Clussio site.

If you do not agree with this Privacy Policy, you may not use the Services or our website. Information gathered through the Services may be transferred, used, and stored in the United Kingdom and in foreign jurisdictions in which we, our agents, customers and other users of the Services are located. If you access the Services, you consent to the transfer, use and storage of your Personal Information (as defined below) in those jurisdictions. The data protection and other laws of the United Kingdom and other countries might not be as comprehensive as those in your country.

You further agree that all transactions relating to the Services or our website shall be deemed to have occurred in the United Kingdom.


2. Registration

If you register with us you confirm that you are at least sixteen years of age. The details provided by you on registration or at any time are important. The registered user undertakes to ensure that they are correct and complete. You undertake to inform us immediately of any changes to the information you provided when registering by updating your personal details.


3. Password and Security

When you register to use the Clussio site you may be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. Please note that you will be responsible for activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us immediately.


4. Collection of Personal Information

We collect Personal Information in connection with our Services. When we use the term “Personal Information” we are talking about information that can be used to identify an individual and may include, but is not limited to, your name, address, email address, phone number (or other government-issued identification number) and any profile information you choose to submit through our website. Given that interviewing companies use our Services to interview job candidates remotely, the term “Personal Information” may also include, but not be limited to, your image (still and video), photograph and likeness and your voice, work history, knowledge, skills, abilities, resume data, work style and answers to interview questions. If you are a resident of the European Union, we will also treat your IP address as Personal Information.

Clussio may also collect non-Personal Information (aggregate, non-individually identifiable or demographic). An example of non-Personal Information would be system-related information such as IP addresses (unless you are a resident of the European Union), use information, browser and browser speed, bandwidth of your Internet connectivity, general location of your server and the pages of our site that were viewed during a visit. We use this information for internal purposes to help us diagnose problems, monitor traffic patterns and otherwise continually improve our Services.

When you access the Services through an interviewing company”s or your company”s or personal website or linked web pages your Personal Information may be disclosed to us and/or the relevant interviewing company or your company. In that case, the use of your Personal Information by the interviewing company or your company will be subject to their privacy T&C. Furthermore, the Services may provide links to third party sites, such as the websites of interviewing or training companies. We are not responsible for the privacy policies, practices or the content of websites owned by others that you may link to or that may be linked from the Services. Accordingly, we encourage you to review the privacy policies and terms of service of those websites so that you understand how those websites collect, use and share any Personal Information.


5. Use of Personal Information

Only the interviewing company, your company, authorized Clussio employees and service providers and authorized designees of the interviewing company or your company have access to Personal Information. Clussio uses the Personal Information to assist us in setting up accounts; improving online operations; processing transactions; providing customer service; providing you with newsletters, RSS feeds, and/or other communications or services which you have signed up for or otherwise agreed to receive; sending account- or transaction-related communications such as welcome letters and transaction confirmations; performing research and analysis aimed at improving our products, services and technologies; and managing our systems. We will only use your Personal Information in the way we specified when it was collected (including as described in these T&Cs). If we use Personal Information in a manner different than the purpose for which it was collected (including as described in these T&Cs), then we will ask for your consent prior to such use. If we propose to use Personal Information for any purposes other than those described in these T&Cs, then you may opt out of the use of Personal Information for those other purposes by e-mailing us at admin@clussio.com. We will retain your information for as long as your account is active or as needed to provide you with the Services or as we deem necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. If you wish to cancel your account or request that we no longer use your information to provide you with the Services, please contact us at admin@clussio.com.


6. Disclosure of Personal Information

We do not share, sell, rent or trade your Personal Information with third parties other than as disclosed within our T&Cs.

We may disclose Personal Information and non-Personal Information to other users of the Services (for instance, to interviewing companies if you are a job candidate) and to service providers and other agents engaged to perform functions on our behalf (such as processing of payments, provision of data storage, hosting of our website, marketing of our products and services, conducting audits, and performing web analytics) or on behalf of the interviewing companies. We may also disclose your Personal Information to third parties when we believe, in good faith and in our sole discretion, that such disclosure is reasonably necessary to (a) enforce or apply the terms and conditions of the Services, including investigation of potential violations thereof, (b) comply with legal or regulatory requirements or an enforceable governmental request, (c) protect the rights, property or safety of us, our users or other third parties, (d) prevent a crime or protect national security, or (e) detect, prevent or otherwise address fraud, security or technical issues. We may also disclose non-Personal Information to our clients, business partners, merchants, advertisers, investors, potential buyers and other third parties if we deem such disclosure, in our sole discretion, to have sound business reasons or justifications. We do not sell, rent, share or trade your Personal Information to third parties for marketing purposes unless you have granted us permission to do so.


7. Audio and Video Recordings of Interviews

Interviewing companies use our Services to interview job candidates remotely. The interviewer asks the job candidates” questions via the use of selected Avatars and the job candidates provide answers during the interview via their personal or company webcam. Audio and video recordings of those interviews are made available to the respective company conducting the interviews. The recorded interviews are stored for the period of time dictated by the interviewing company or our internal policy, after which time they will be deleted unless the interviewing company has chosen to archive the information for a longer period.

It is expressly stated that the candidate is solely responsible for accessing the use of computer equipment and internet bandwidth connectivity sufficient to enable video streaming uploading of appropriate quality for storage and review. Clussio is not a data controller of any information recorded in an interview. Clussio simply acts as a data processor that facilitates the recording of the data and transmits any personal data contained in the interview from the candidate to the interviewer. We maintain a copy of the interview on the hosting servers of our hosting partners for controlled access by the nominated representative of the interviewer. Candidates wishing to raise any issues with regard to the interview should contact the interviewing company, as the interviewing company is the data controller of the interview. The use and disclosure by interviewing companies (and their agents and service providers) of Personal Information contained in a recorded interview is governed by the applicable interviewing company”s privacy T&Cs, not by this Privacy T&Cs.


8. Accessing and Updating Personal Information

When you use our Services, we make good faith efforts to provide you with access to your Personal Information and either to correct or amend this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for some other reason as permitted in these T&Cs. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backups), or for which access is not otherwise required. In any case, where we provide information access, amendment and/or correction, we perform this service free of charge, except if doing so would require a disproportionate effort.

We will attempt to respond to your request within thirty (30) days. You may also email us at admin@clussio.com if you would like to opt out of having your Personal Information shared with third parties other than our service providers and other agents (or disclosures permitted under these T&Cs, such as disclosures we deem necessary to enforce our terms and conditions or to comply with legal or regulatory requirements). Please be aware, however, that if you delete your Personal Information or opt out of our sharing it, you may not be able to continue to use the website or the Services.


9. International Users

By visiting our website and by providing us with your Personal Information or data, you acknowledge and agree that due to the international dimension of Clussio we may use the Personal Information or data collected in the course of our relationship for the purposes identified in these articles and in our Terms and Conditions or in our other communications with you, including the transmission of information outside your resident jurisdiction. In addition, please understand that such Personal Information and data may be stored on servers located in the United Kingdom and other countries. By providing us with your Personal Information or data, you consent to the transfer of such data.


10. Children

We do not knowingly or specifically collect Personal Information from users under 16 years of age. We do not authorize users under 16 years of age to use the Services or our website. If we learn that we have collected Personal Information on a child under the age of 16, we will delete that data from our systems.


11. Information Security

Clussio uses reasonable efforts to protect your Personal Information from loss, misuse, unauthorized access, disclosure, alteration, and/or destruction. We have built our entire technology system so that neither interviewing companies nor job candidates can access company or candidate information without an appropriate password. In addition, we utilise Secure Socket Layer (SSL) encryption technology when data is transmitted over the Internet, and have installed firewalls to help prevent external access into our network. In addition, our servers are hosted at a leading third-party facility for added security and reliability. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its security.

We restrict access to Personal Information to Clussio employees, contractors, service providers and agents who need to know that information in order to operate, develop or improve our Services or website. These individuals are bound by confidentiality and privacy obligations consistent with these T&Cs and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.


12. Sale of the Business

Clussio reserves the right to transfer information (including your Personal Information) to a third party in the event of a sale, merger, or transfer of all or substantially all of the assets of our company, or in the unlikely event of a bankruptcy, liquidation or receivership of our business, provided that the third party agrees to adhere to the terms of our T&Cs. You will be notified via prominent notice on our website for thirty (30) days of any such change in ownership or control of your Personal Information.

13. Your Privacy Rights

As stated in our T&Cs, we do not share information with third parties for their own direct marketing purposes unless you affirmatively agree to such disclosure — typically by opting in to receive information from a third party. If you do ask us to share your information with a third party for its marketing purposes, we will only share information in connection with that specific situation, as we do not share information with any third party for their own direct marketing purposes on a continual basis. To prevent disclosure of your Personal Information for use in direct marketing by a third party for its own purposes, do not opt in to such use when you provide Personal Information on one of our sites. Please note that whenever you opt in to receive future communications from a third party, your information will be subject to the third party”s privacy policy. If you later decide that you do not want that third party to use your information, you will need to contact the third party directly, as we have no control over how third parties use information. Clussio reserves the right to change this Privacy Policy at any time. In particular, and without limiting the foregoing, we may modify this Policy to reflect changes in the way we collect, use or disclose information, or to reflect changes in privacy laws, regulations and/or industry standards. We encourage you to review this Privacy Policy when accessing the Services.

We may update this Privacy Policy to reflect changes to our information practices. If we make any material changes we will notify you by e-mail (sent to the e-mail address specified in your account) or by means of a notice on our website prior to the change becoming effective. Your continued use of the Clussio website or the Services after any notice will signify and confirm your assent to those changes. However, we will not apply any material changes to Personal Information collected prior to the posting of such changes without obtaining your affirmative consent.

16. Our Liability

Whilst we endeavour to ensure that information on the Clussio site is correct, and that technology used in the provision of services is “fit for purpose”, we shall not be liable for any damages arising from the use or inability to use the Clussio site or any information contained on it or from any action or decision taken as a result of using the Clussio site or any such information.

To the maximum extent permitted by applicable law we disclaim liability for all implied or statutory warranties and conditions. To the maximum extent permitted by applicable law, in no event shall we, nor our employees, affiliates, agents or other representatives, be liable for any special, indirect or consequential damages whatsoever including without limitation damages for loss of profits, loss of confidential or other information, loss of job opportunity, business interruption arising from or in connection with the use of the Clussio site or otherwise in connection with the provision of goods and services under our Terms and Conditions. Nothing in this clause affects our liability for death or personal injury arising from our negligence, or our liability in relation to any fraudulent misrepresentation.

You hereby undertake, as a condition of use of the Clussio site, to indemnify us against any loss or damage suffered by us as a result of any breach by you of any of these Terms of Conditions.


18. Law

These Terms and Conditions and any disputes arising from or in connection with them shall be governed by the laws of England and the parties submit to the exclusive jurisdiction of the English Courts. We do not make any promise that the materials on the Clussio site are appropriate or available for use in locations outside the United Kingdom and using the Clussio site from territories where its use or material or contents is unlawful is prohibited.
